GomuGomu Pins Shop Terms and Conditions

By purchasing any product from GomuGomu Pins (referred to as "The Shop"), you, the customer ("The Buyer"), agree to be bound by the following Terms and Conditions, including our full Refund, Shipping, and Presale Policies.

1. Product Nature and Fair Use Disclaimer

Nature of Products: All items sold by The Shop are creative works of fanart and are intended as parodies or homages. They are not intended to be taken as official merchandise or serious commercial products.

Fair Use Doctrine: The Shop operates under the principle of Fair Use, a legal doctrine that permits the limited use of copyrighted material without requiring permission from the copyright holder for purposes such as parody, commentary, and criticism. By purchasing our products, you acknowledge and accept that you are buying an original piece of fanart created under this doctrine.

2. Refund and Return Policy

A. Non-Refundable Purchases

The Shop does NOT accept refund or cancellation requests for the following reasons under any circumstances:

  1. Buyer's Remorse: Changing your mind after purchase.
  2. Accidental Purchase: Purchases made in error.
  3. Drop Buddy Purchases: Purchases made for or by a third party (you must resolve payment issues directly with that person).

48-Hour Denial Policy: Refund requests made within 48 hours of purchase will be denied under the assumption that the request falls under one of the non-refundable reasons listed above.

B. Damaged or Defective Products

If you believe you were sent a damaged or defective product, you must initiate contact within 2 days of receiving the item.

  1. Please email us immediately at [email protected].
  2. Include your order number in the subject or body of the email.
  3. Attach a clear photo of the damaged item showing the defect.

C. Quality Concerns

If you are generally unhappy with the quality of your product (excluding major damage as noted above), please email [email protected] to discuss the issue. We handle quality disputes on a case-by-case basis.

D. Customer Responsibility for Returns

Depending on the approved return reason, The Buyer may be responsible for various associated costs. These costs may include, but are not limited to:

  • Shipping costs (for returning the item).
  • Restocking fees.
  • Processing fees.

3. Shipping Policy

Shipping Carriers and Insurance: We ship all orders via USPS.

  • US Ground and US Priority Shipping: Both include a tracking number and $100.00 USD of insurance.
  • International Shipping (USPS First Class International): Includes a tracking number but NO insurance.

Additional Insurance: Additional insurance can be purchased separately. If you would like to add insurance to your international order OR any order over $100.00 USD, please send an email with your order number. We will send an invoice for the added costs of insurance, which is typically $1-$3 USD.

Lost or Stolen Mail: We are not responsible for lost or stolen mail. Once the pin has shipped and tracking begins, it is out of our control. The Buyer must contact their local post office to file a missing mail claim.

Package Interception: Package interception can be requested by the original purchaser for an additional fee of $25.00 USD. This fee will be collected via PayPal Goods and Services before interception is initiated.

Address and Order Integrity:

  • Address Changes: We accept address change requests within 2 days of purchase. Please contact us ASAP to submit your request.
  • Order Splitting: We will not split orders to multiple shipping addresses. Items purchased together will ship together.
  • Recipient Name: We will only ship to the name of the original buyer to prevent shipping errors and protect your purchase.

4. Presale Policy

Presale Definition: Presales are purchases of pins that are NOT yet in hand. These items are not anticipated to ship until production has completed and the product has passed Quality Control (QC).

Production Time: Production times vary by the complexity of the design and manufacturer speed.

  • The standard production time is 4–7 months after an approved sample.
  • In rare and extreme cases, production time can take up to 10–11 months to be completed.

Buyer Acknowledgment: Please do not participate in presales if you are uncomfortable waiting the applicable timeframe. By purchasing a presale, you agree to wait the production time needed to create the pin.

Presale Updates: Updates for presales will be shared on our Instagram as they are received from the manufacturer. These updates will also be saved to a 'Highlights' tab on Instagram.

Presale Refund Exception: If production time exceeds 6 months past the original estimated fulfillment date, and you are uncomfortable waiting, please contact us at [email protected] for a refund.

5. General Terms and Use

A. Site Content

The contents of this Site are intended for personal, non-commercial use, with the exception of the ability to purchase goods online. You may not reproduce, publish, transmit, distribute, display, modify, create derivative works from, sell or participate in any sale of, or exploit in any way, in whole or in part, any of the Contents, the Site, or any related software.

B. Trading Restriction

Any product purchased from The Shop CANNOT be traded or re-sold at any Walt Disney theme parks nor any other theme parks that have an official pin trading system.

6. Agreement to Terms

By purchasing from GomuGomu Pins, The Buyer explicitly agrees to these Terms and Conditions and the associated Refund, Shipping, and Presale Policies in their entirety.
